The Tuscany Trail is a non-competitive cycling gathering, which develops on dirt roads, paths and mule tracks, exclusively for members of Bike Soul SSDrl (hereinafter also referred to as the event, or improperly as a race or adventure).

Art. 1 – Registration All individuals who have reached the age of 18 at the time of registration and belong to any nationality are admitted to the gathering.

Art. 2 – Affiliation The Tuscany Trail is an event exclusively for members of Bike Soul SSDrl. Those not already members of the said sports society will become members upon registration for the event. The Organization may at any time and at its sole discretion decide whether to accept or reject a registration or to exclude a registered participant from the event if they may cause damage to its image.

ART. 3 – Medical Certificate

All participants MUST present to the organization a medical fitness certificate for cycling (Medical Certificate for Cycling) in accordance with DM 24/04/2013, issued by a Sports Medical Center or a Doctor, valid at the time. The medical certificate must be valid beyond June 30, 2024, and must be uploaded after registration. Non Italian participants can request a template for the certificate.

The medical certificate must be uploaded on the website www.tuscanytrail.it through the site area called “My account” https://www.tuscanytrail.it/my-account/. The expiration date of the medical certificate must also be specified.

If the medical certificate is not compliant, it will be rejected and deleted, and the registrant must submit a new compliant one by April 15, 2024.

The Competitive Medical Certificate must be specific for CYCLING. We cannot accept medical certificates issued for other sports disciplines such as triathlon, athletics, etc.

Those who do not comply with this requirement will not be considered regularly registered and are not entitled to a refund of the registration fee.

Each participant must declare under D.P.R. n. 445 of December 28, 2000, that the documents submitted are truthful and correspond to the originals in their possession.

Art. 4 – Route and Track

The route starts and ends in Castagneto Carducci (LI). The route is approximately 470 km long. The track runs on dirt roads, single tracks, and paved roads. The organization will provide all participants with a .gpx format track of the route to follow to the finish, but it is reminded that, at any time and for any reason related to safety, as well as traffic and road conditions, including road works, detours, prohibitions, and any other unpredictable situation that may be encountered along the provided track, everyone is free, at their own discretion, to leave the track and resume it as soon as these critical conditions have ceased and safety is again guaranteed. Therefore, you can deviate from the provided track at any time and then resume it later, using alternative roads at your discretion, if conditions require it. The organization reserves the right to modify the route up to a few days before the start.

Art. 5 – Group Start Event date and start location: May 24 and 25, 2024 – Via Vecchia Aurelia, 1, 57022 Donoratico LI You must choose the start date at the time of registration. The date is binding and cannot be changed. Those starting on Friday, May 24, must collect the event package on the afternoon of Thursday, May 23, or the morning of Friday, May 24. Those starting on Saturday, May 25, must collect the event package on the afternoon of Friday, May 24, or the morning of Saturday, May 25. The times will be communicated later in the digital guide.

Art. 6 – Compliance with the Road Code The Tuscany Trail is a FREE EXCURSION WALK on dirt roads, trails, and paved roads; the entire route will always be open to traffic, and therefore compliance with the Road Code is mandatory for all participants. It is also mandatory to have a repair kit for breakdowns and punctures.

Art. 7 – Characteristics of the event – warning All participants must:

be physically prepared

have off-road driving skills

have a spirit of adaptability

have a good knowledge of GPS use and basic orientation

In the spirit of bikepacking, any type of external support is prohibited (except obviously in emergency cases).

Art. 8 – Mandatory Kit For their personal safety, in case of emergency or loss of route, each participant is required to carry with them, for the entire duration of their adventure, the following minimum safety equipment:

reflective vest

whistle or bell

cell phone

approved helmet to be worn at all times

front white light and rear red light

Art. 9 – Registrations and Participation Fee

Registration opening: December 11, 2023, at 11:00 Registration closing: January 19, 2024

Registration cost:

97 Euros from December 11, 2023, to January 7, 2024 127 Euros from January 8 to January 19, 2024

The first 3500 people who register for the Tuscany Trail 2024, in chronological order based on the registration date on the site, will receive the “Tuscany Trail 2024 – Montura” cycling jersey as a gift. The jersey is exclusive to the first 3500 registered and will be delivered in person only during the registration phases at the Parco delle Sughere in Donoratico. From this year you have the option to choose the size at the time of registration. Art. 10 – Validity of Registration Registration will be considered valid only after completing the electronic registration procedure with consequent electronic credit of the amount in favor of the organizer and sending the medical certificate which must be uploaded by April 15, 2024, within the My Account section. The organization may, at any time and at its sole discretion, without obligation to provide further motivation, decide whether or not to accept the registration of anyone.

Art. 11 – Substitution and Withdrawal from Participation With reference to the Event, it is not possible to request the substitution of a participant once registered. If a registered participant does not participate in the event, the participation fee will not be refunded under any circumstances and the race package will not be shipped.

Art. 12 – Cancellation or Postponement of the Event Cancellation – If, due to force majeure such as pandemics or wars, the event does not take place, the amount paid at the time of registration will not be refunded, but only the participation fee will be considered valid in case of request for registration for the following edition. The organization will also be entitled to a contribution regarding insurance expenses amounting to €14.00 for the postponement of the registration to the following year. The request for registration for the following year and the payment of the secretariat fee must be made within the date indicated by the organization after the cancellation of the event. Postponement – Furthermore, for reasons of force majeure or other serious reasons, such as pandemics or wars, which could jeopardize the preparation of the event or the participation in it by a number of people not less than half of the registered, the Organization reserves the right to move the place and/or the date of the event within the same calendar year. In this case, the amount paid for the registration will be valid for the rescheduled event, without additional costs for the registered participants. In this case, it is not possible to postpone the registration to the edition of the following year.

Art. 12 – Changes In light of new environmental and/or health circumstances and/or in case of changes in the regulatory framework, the Organization reserves the right at any time to make reasonable changes to the regulations. The official event website where this regulation is published constitutes the only reference for information about the event. Therefore, different contents present in previous communications via newsletter, in the press, or on social media cannot be invoked.

Art. 13 – Approval, Consent, Authorization, etc. By requesting to participate in the Tuscany Trail, each participant at the time of registration:

Declares to have read and approved this Regulation and to accept every part of it;

Guarantees their own behavior during and after the event;

Declares to be in good physical condition and to have submitted to the organization a valid medical certificate after undergoing a medical fitness examination for cycling (Competitive Medical Certificate for Cycling), providing the organization with the broadest indemnity for any damage that may be suffered as a result of their participation in the event;

Declares to be aware that the event in which they participate is a non-competitive test without rankings;

Declares to be aware that there is no health, food, or mechanical assistance service provided by the organizers of the cycling event named Tuscany Trail;

Declares to be aware that there is no service for the recovery of those who retire, nor are there obligations on the part of the organizers to search for participants along the route;

Declares to be aware that there is no obligation on the part of the organization to monitor the roads crossed by the participating cyclists;

Declares to be aware that the participation fee will not be refunded under any circumstances;

Declares to have experience and be aware of the possibility of encountering adverse weather conditions and to be able to navigate and cycle in hills and medium mountains in such conditions;

Declares to be aware that the organizer “Bike Soul SSDrl” is not a professional organizing entity, but acts for purely recreational and non-profit purposes (1174 Cod.civ.); therefore, participation in the Tuscany Trail always occurs by free choice and for recreational purposes, nevertheless non-profit. Consequently, the organizing SSDrl mentioned above is exempt, and in any case indemnified, from any responsibility connected to the Tuscany Trail excursion. It is also indemnified from any liability regarding events that occur to the cyclist during the Tuscany Trail such as accidents, loss of the route, physical problems, incidents, thefts, etc. Therefore, the Tuscany Trail cycling excursion is to be understood as a mere meeting with spontaneous and independent participation of cycle tourists and amateur cyclists in a free and personal excursion; – that purely out of hospitality and courtesy without the requirements ex art 1174 and subsequent Cod.civ. the organizing SSDrl mentioned above may organize one or more refreshment points for the participants, subject to voluntary contribution, which the cyclist undertakes to pay before undertaking the Tuscany Trail cycling excursion;

Declares that, therefore, the cyclist who participates in the Tuscany Trail cycling excursion renounces to undertake any legal action for any reason against the aforementioned organizing SSDrl, recognizing that it is a non-professional association that acts for recreational purposes without the requirements (ex art 1174 Cod.civ.)

Expresses consent to the use of their data, also for commercial purposes, according to the single text on privacy n. 196 of 30/06/2003 and the European Union Regulation on privacy 2017/679 (GDPR/18);

Grants the organizers the broadest consent to the use, in ways permitted by law, also for profit, of any video or photographic image taken during the days of the event, providing the organization with the power to transfer such images to third parties. The aforementioned authorization for the use of one’s image is to be considered granted indefinitely and without territorial limits throughout the world, for use in various publications and films, including, but not limited to, promotional and/or advertising materials produced on all media. The organization may also transfer to third parties and its institutional and commercial partners the rights of use provided for in this agreement. The organization declines all responsibility for itself and its collaborators, for accidents or damage to persons or things, which may occur before, during, and after the event or as a result of the same.

Art. 14 – Processing and Registration of Personal Data The processing and registration of personal data will be carried out by the following company: Bike Soul SSDrl 59100 Prato (PO), Italy C.F./P.I. 02379130970 The personal data of all participants will be processed and registered according to the single text on privacy n. 196 of 30/06/2003 and the European Union Regulation on privacy 2017/679 (GDPR/18).

TRANSFER OF PERSONAL DATA TO ADVENTURELAB srl FOR THEIR MARKETING PURPOSES. Having taken note of the privacy information, with the user’s consent, Tuscany Trail will communicate personal data to AdventureLab srl for their marketing purposes.

 You may find out which of your data is processed by the Partner and, where conditions permit, exercise the various rights relating to their use (right of access, rectification, updating, integration, cancellation, limitation to processing, portability, revocation of consent to processing and obtaining a copy of your data where these are stored in countries outside the European Union, as well as obtaining an indication of the place where such data is stored or transferred) and oppose for legitimate reasons to their particular processing and in any case to their use for commercial purposes, in whole or in part even with regard to the use of automated methods by contacting: [email protected] or the Data Protection Officer (RPD), contactable via e-mail at “[email protected]“. Your data will not be disclosed and will be processed with suitable methods and procedures, including computerized ones, by our employees, collaborators, and other external subjects, designated as Data Processing Managers or, in any case, operating as Data Controllers, who are involved in the management of relationships with you in existence or who perform technical, organizational, and operational tasks on our behalf.
